All performers performing at Pasifika Festival are required to complete this section.
By choosing “Yes, I agree” and submitting the form, you, and the group of performers represented by you in this registration (together, the “Performer”), grant ATEED (including it sponsors, sponsored parties and duly authorised agents) the right to:
(i) change or cancel the performance, in its sole and absolute discretion, in the following circumstances:
- bad weather that the Event has to be changed or cancelled
- the performer(s) failing to appear in time for the allocated performance time slot
- the content of the performance, including costumes, music, lyrics etc., not supporting the culture and values of the Event
- props and equipment etc being non-compliant to Health and Safety guidelines or potentially damaging the heritage or environment of the venue
(ii) alter the programme due to unexpected delay, which might result in cancellation of later performances;
(iii) take the Recordings of the Performer at the Event; and
(iv) use the Recordings for the Permitted Purpose worldwide during the Term, free of charge.
ATEED shall not be required to give attribution to the Performer, but may choose to do so where it considers appropriate. For the purpose of any attribution, the Performer grants ATEED the right to use the Performer's name, likeness and any other relevant details about the Performer.
All the Performer's intellectual property rights in their performance recorded in the Recordings shall remain the property of the Performer and may be used by ATEED in relation to its use of the Recordings only.
Terms Used
ATEED Auckland Tourism Events and Economic Development.
Event: Pasifika Festival (14-15 March 2020).
Permitted Purpose: Promotion, publicity, advertising and profiling of the Event, the city of Auckland, ATEED, Auckland Council, and (paid or otherwise).
Recordings: Photographs and/or video/film and/or sound recordings.
Term: In perpetuity.
Acknowledgement
The Performer acknowledges and agrees that:
(i) it has read and understood the above;
(ii) it has the right and authority to grant the rights herein;
(iii) the rights granted will not infringe the rights of any third parties; and
(iv) it waives and releases ATEED from any claims in connection with making the Recordings or use of the Recordings for the Permitted Purpose, including claims based on moral rights.
